1. Acceptance of Terms

By accessing and using Hyperliquid trading platform, you accept and agree to be bound by the terms and provisions of this agreement. If you do not agree to these terms, please do not use our services.

2. Eligibility

You must be at least 18 years old and have the legal capacity to enter into contracts in your jurisdiction. By using our platform, you represent and warrant that you meet these requirements.

Our services are not available to residents of restricted jurisdictions including but not limited to the United States, North Korea, Iran, Syria, and other sanctioned territories.

3. Trading Risks

Trading perpetual futures and leveraged products involves substantial risk of loss. You acknowledge and accept that:

• You may lose more than your initial investment when using leverage
• Market volatility can result in rapid and significant losses
• Past performance does not guarantee future results
• You are solely responsible for your trading decisions
• You should only trade with funds you can afford to lose

4. Account Security

You are responsible for maintaining the security of your wallet and private keys. Hyperliquid is a non-custodial platform and cannot recover lost keys or reverse transactions. You agree to:

• Keep your private keys secure and confidential
• Not share your wallet access with unauthorized parties
• Immediately notify us of any suspected security breaches
• Accept full responsibility for all activities under your account

5. Prohibited Activities

You agree not to engage in any of the following prohibited activities:

• Market manipulation, wash trading, or spoofing
• Using our platform for money laundering or terrorist financing
• Attempting to gain unauthorized access to our systems
• Using automated trading systems that violate our API terms
• Engaging in fraudulent or deceptive practices

6. Fees and Charges

Trading fees are clearly displayed on our platform and may vary based on your trading volume. We reserve the right to modify our fee structure with prior notice. Funding rates for perpetual positions are determined by market conditions.

7. Platform Availability

While we strive for maximum uptime, we do not guarantee uninterrupted access to our platform. We may suspend or modify services for maintenance, updates, or in response to regulatory requirements without liability.

8. Intellectual Property

All content, trademarks, and intellectual property on our platform are owned by Hyperliquid or our licensors. You may not use, reproduce, or distribute our content without explicit permission.

9. Limitation of Liability

To the maximum extent permitted by law, Hyperliquid and its affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use of our platform.

10. Indemnification

You agree to indemnify and hold harmless Hyperliquid, its officers, directors, and employees from any claims, damages, or expenses arising from your use of our services or violation of these terms.

11. Dispute Resolution

Any disputes arising from these terms shall be resolved through binding arbitration in accordance with international arbitration rules. You waive your right to participate in class action lawsuits.

12. Modifications to Terms

We reserve the right to modify these terms at any time. Continued use of our platform after changes constitutes acceptance of the modified terms. We will provide notice of material changes.

13. Termination

We may terminate or suspend your access to our platform at our sole discretion, without prior notice, for conduct that we believe violates these terms or is harmful to other users or our platform.

14. Governing Law

These terms shall be governed by and construed in accordance with international law, without regard to conflict of law provisions.
